U.S. Court of Appeals Decision Safeguards Operation of MassBroadband 123 Network

Last year, the Network Operator of the MassBroadband 123 network, KCST, Inc., formerly Axia NGNetworks, USA, Inc. (“Axia”), commenced a chapter 11 bankruptcy case with the U.S. Bankruptcy Court, District of Massachusetts. In a recent parallel court proceeding, the United States Court of Appeals for the First Circuit affirmed a decision made by a lower court that AxiaNetMedia must continue its obligations under the Guaranty Agreement it signed with the Massachusetts Technology Collaborative back in 2011. For MassTech and the Commonwealth, as the owner of the network, this was another positive legal decision which supports MassTech's contract with the Network Operator and ensures continued delivery of services to the many public institutions and private companies that take service from it.
